1. About these terms

These terms apply to caretechhuman.com, the Biomonix product site, and the UroWell product site. We call them “our sites”.

Our sites are operated by CareTech Human Inc., a Delaware corporation with offices at 526 Campus Road, Weill Hall 407a, Ithaca, NY 14853.

By using our sites you accept these terms. If you do not accept them, do not use our sites.

These terms do not cover the purchase of a device. If you reserve a Biomonix or place a deposit, the Early Access Terms apply to that purchase, and they take priority over these terms where the two differ.

Our Privacy Policy explains what we do with personal data. It forms part of these terms.

2. Who can use our sites

You must be 18 or older.

You may read our pages, contact us, apply for a job, and join the Early Access list. You may share links to our pages.

You may not:

• copy, republish, or resell our content without our written permission
• use automated tools to scrape, crawl at a rate that disrupts the site, or collect data from our sites, except for search engines following our robots.txt
• attempt to gain access to systems, accounts, or data you are not entitled to
• interfere with the operation of our sites
• submit false information, impersonate another person, or upload anything containing malware
• use our sites to send unsolicited commercial messages

We may restrict or block access if you do any of these.

3. What our sites are, and what they are not

Our sites describe products we are developing, the science behind them, and the company.

Nothing on our sites is medical advice. Our content is for general information and wellness purposes. It is not intended to diagnose, treat, cure, or prevent any disease. Do not use it to decide anything about your own health or anyone else’s.

If you have a health concern, talk to a qualified healthcare professional. If you think you have a medical emergency, call your local emergency number.

Product descriptions cover work in progress. Our sites describe capabilities that exist today and capabilities we are developing. We label them as such, but features, specifications, prices, and availability can change, and some capabilities under development may not reach the market. Nothing on our sites is a promise that a specific feature will be released, or released by a particular date.

Research and clinical collaborations. We name universities, hospitals, and clinicians we work with. Naming a collaborator does not mean that institution or person endorses our products, or that a product has been validated or approved for any medical purpose.

4. What you send us

You are responsible for what you submit through our forms, including messages, resumes, and uploaded files. Do not submit anything you do not have the right to share, and do not include other people’s personal data without their knowledge.

If you send us an idea, a suggestion, or feedback about our products, you give us permission to use it without payment or obligation to you. We may already be working on something similar. Do not send us confidential information through our forms.

5. Our content and trademarks

The content of our sites, including text, images, video, graphics, layout, and code, belongs to CareTech Human Inc. or our licensors, and is protected by copyright and other laws.

Biomonix and UroWell are trademarks of CareTech Human Inc. Other names and logos on our sites belong to their owners, and appear only to identify those companies and institutions.

You may quote short extracts of our content with attribution and a link. Anything more needs our written permission.

6. Other websites

Our sites link to websites we do not control. We are not responsible for their content, their products, or how they handle your data. Read their terms and privacy policies before you use them.

7. Availability

We do not promise that our sites will be available without interruption, or free of errors. We may change, suspend, or withdraw any part of them at any time, without notice.

8. Limits on our liability

Our sites are provided as they are. To the extent the law allows, we make no warranties about them, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising from your use of our sites.

Our total liability arising from these terms or from your use of our sites is limited to $100.

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, for death or personal injury caused by negligence, and any rights you have as a consumer that cannot be waived.

If you live in the European Economic Area or the United Kingdom, your statutory consumer rights are not affected by this section.

9. Indemnity

If someone brings a claim against us because you broke these terms or misused our sites, you agree to cover our reasonable costs and legal fees in dealing with it, to the extent the law allows.

10. Governing law and disputes

These terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Disputes will be heard in the state or federal courts located in New York.

If you live in the European Economic Area or the United Kingdom, this does not deprive you of the protection of the mandatory consumer law of the country where you live, or of the right to bring proceedings there.

11. Changes to these terms

We may update these terms. The date at the top shows when we last changed them. Continuing to use our sites after a change means you accept the new version.

If a change affects a purchase you have already made, the terms that applied at the time of your purchase continue to apply to it.

12. General

If a court finds part of these terms unenforceable, the rest stays in force.

If we do not enforce a term straight away, we do not lose the right to enforce it later.

These terms, together with the Privacy Policy and, where they apply, the Early Access Terms, are the whole agreement between you and us about your use of our sites.

You may not transfer your rights under these terms to anyone else. We may transfer ours as part of a merger, acquisition, or sale of assets.
